These terms govern your use of this website. Applications we publish are licensed separately.

This website is operated by Bufflehead Software LLC, a Pennsylvania limited liability company ("Bufflehead Software", "we", "us"). By using buffleheadsoftware.com you agree to these terms. If you do not agree, please do not use the site.

1. What this site is

This website provides information about our company and the software we publish, and a means of contacting us. It is informational. Nothing on it is an offer to sell, a warranty, professional advice, or a binding commitment to build or continue any product.

2. Applications are licensed separately

These terms do not govern our applications. Software distributed through the Apple App Store is licensed to you under Apple's Licensed Application End User License Agreement, or under a custom licence supplied with the application where we provide one. Your rights in an application come from that licence, not from this page.

3. Acceptable use

You may read, print, and link to these pages freely. You agree not to:

• attempt to gain unauthorized access to the site, its hosting, or any connected system;
• interfere with the site's operation or availability, including by automated flooding;
• scrape or reproduce the site's content at scale for republication as your own;
• use the site to transmit unlawful, infringing, or malicious material; or
• misrepresent yourself as affiliated with, endorsed by, or speaking for Bufflehead Software.

4. Intellectual property

The text, design, code, and graphics on this site, including the bufflehead mark and the name "Bufflehead Software", are owned by Bufflehead Software LLC and protected by copyright and trademark law. You may quote short passages with attribution and link to any page. You may not use our name or mark in a way that suggests affiliation or endorsement without written permission.

5. Links to other sites

We link to third-party sites — Apple, our registered agent, government registries — for your convenience. We do not control them and are not responsible for their content, availability, or privacy practices. A link is not an endorsement.

6. Availability

We provide this site on an "as is" and "as available" basis. We may change, suspend, or discontinue any part of it at any time without notice. We do not warrant that it will be uninterrupted, error-free, or free of harmful components, and we do not warrant the accuracy or completeness of its content.

7. Disclaimer of warranties

To the fullest extent permitted by law, we disclaim all warranties relating to this site, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

8. Limitation of liability

To the fullest extent permitted by law, Bufflehead Software LLC and its member, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to your use of this site, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages. Where liability cannot lawfully be excluded, our total aggregate liability arising out of or relating to this site is limited to one hundred United States dollars (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

You agree to indemnify and hold harmless Bufflehead Software LLC from any claim, loss, or expense, including reasonable legal fees, arising from your breach of these terms or your misuse of this site.

Our handling of personal information is described in our privacy policy, which forms part of these terms.

11. Governing law and venue

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of laws rules. Any dispute arising out of or relating to these terms or this site will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the jurisdiction of those courts. If you are a consumer resident elsewhere, this clause does not deprive you of the protection of mandatory consumer law in your place of residence.

12. Changes to these terms

We may revise these terms. The version in force is the one published on this page, and the date below shows when it last changed. Continuing to use the site after a change means you accept the revised terms.

13. Severability and entire agreement

If any provision of these terms is held unenforceable, the remainder stays in force. These terms are the entire agreement between you and us regarding this website.
